Error while ''downloding'' patch

whenever i try to open the launcher, it tells me, and i quote:
Error occurred while downloding patch. Restart the game again.
And yes, it said downloding.
Been restarting the game like 10 times now, no difference. 
i have already resolved the 1.2.8 to 1.2.9 patch problem earlier.

Anyone else got this problem/ knows how to help?

    My game is in 1.3.9 patch. (history.config told me)
